PUBLISHED NORMATIVE INSTRUCTION THAT REGULATES THE RURAL TAX REGULARIZATION PROGRAM (“PRR”)

Normative Instruction No. 1,728, which regulates the PRR within the scope of the Brazilian Federal Revenue Service (“RFB”), established by Provisional Measure No. 793, was published in the Official Gazette (“DOU”) today (15.8.2017).

The installment is intended to be paid by rural producers and individual purchasers of rural production of individuals, of debts of social security contribution of the rural employer, replacing contributions due by employers, expired on or before April 30, 2017, subject to tax assessments or not, including the ones subject to previous terminated or active installments, or under administrative or judicial discussion, of which the Social Security and Social Security Fund code (“FPAS”) is 744, subject to the exceptions provided for in the legislation.

The debts of rural producers may be paid, observing the minimum amount of R$ 100.00, as follows:

I – payment of at least 4% (four percent) of the consolidated debt, without the reductions dealt with in the following item, in up to 4 (four) equal and successive installments, payable in the months of September to December of 2017; and

II – installment of the rest of the consolidated debt in up to 176 (one hundred and seventy-six) monthly and successive installments, effective as from January 2018, equivalent to 0.8% (eight tenths) of the monthly average gross revenue of the marketing of its rural production in the calendar year immediately prior to the expiration of the installment, with reductions of 25% (twenty-five percent) of late and legal fines and one hundred percent (100%) of default interest.

The debits of the purchasers of rural production, in turn, will be able to be paid as follows, observing the minimum value of parcel of R $ 1,000.00:

I – payment of at least 4% (four percent) of the consolidated debt, without reductions, in up to 4 (four) equal and successive installments, payable in the months of September to December 2017; and

II – installment of the remainder of the consolidated debt in up to 176 (one hundred and seventy-six) monthly and successive installments, due as from January 2018, with reductions of 25% (twenty five percent) in fines and 100% (one hundred percent) of default interest.

III – The purchaser of rural production of individuals with total debt, without reductions, equal to or less than fifteen million reais (R $ 15,000,000.00), may optionally settle it as follows:

a – payment in kind of at least 4% (four percent) of the consolidated debt, without reductions, in up to 4 (four) equal and successive installments, payable in the months of September to December 2017; and

b – installment of the rest of the consolidated debt in up to 176 (one hundred and seventy-six) monthly and successive installments, effective as of January 2018, equivalent to 0.8% (eight tenths) of the monthly average gross revenue of the commercialization of the calendar year immediately prior to the expiration of the installment, with reductions of 25% (twenty five percent) of the late and legal fines and one hundred percent (100%) of default interest.

The adhesion should occur until 29.9.2017, only being confirmed by the payment of the first installmet of the payment in kind.
