GOVERN REGULATES THE SCIENCE, TECHNOLOGICAL AND INNOVATION LEGAL MARK

Decree No. 9.283/2018 which regulates the Law No. 13.243/2016, related to the Science, Technological and Innovation Legal Mark has the purpose of establishing an incentive to progress and enhance research and innovation; that is, provide environments that gather infrastructure, institutional and cultural arrangements that may attract entrepreneurs and financial resources.

In accordance with the Decree No. 9.283/2018 universities, research centers, funding agencies, public enterprises and mixed capital companies are now able to form strategic alliances to develop cooperation projects between enterprises, Scientific, Technological and Innovation Institutions (“ICT”) and private entities as minority shareholders or through investment funds with the purpose of establishing products and new innovative processes, or, even more, by new public-private partnerships.

Also, another rule provided in the Decree, allows the public entities to support the creation, the execution and consolidation of environments by assigning public property to promote innovated means. A well as participating in the creation and governance of managing entities that provide an innovative environment, or, when appropriate, by grants or loans to establish and consolidate innovated environments, including the transference of public funds to expand the built area or to install new physical structures in private properties.

In addition, with the objective of stimulating the ICT’s participation in the innovation process, the ICT may celebrate technology transfer agreements and grant the right to use or explore the creations by them developed, solely or through partnerships.

There is also the possibility of a technological bonus, that is, a subvention to a microenterprise and to a medium-size company. Such subvention, is based on the state and governing entities budget dotation’s intended on the share-payment and the use of research infrastructure for the technological advance; the recruitment of specialize technology or the technological transfer with such enterprises.
